I am an attorney for FremantleMedia North America, Inc., the parent company of American Idol Productions, Inc. American Idol Productions in conjunction with 19 TV, Ltd., is the producer of the hit television series “American Idol” and owns inter alia, American Idol episodes, American Idol trademark and American Idol service mark, American Idol trade dress and the right to use the names and likenesses of American Idol contestants, hosts, and judges in connection with American Idol. The format, structure, logo, music, and layout of American Idol are unique and protected from unauthorized infringement by Section 101 of the U.S. Copyright Act.
It has come to our attention that you are using the official “American Idol” website to promote your own agenda. We have received hundreds of e-mails and phone calls from angry “American Idol” viewers reporting your fraudulent and deceitful website at the expense of our intellectual property. Your use of our website without our permission violates our intellectual property rights, dilutes the value of our business, and causes severe injury to the producer of American Idol. In addition, your unauthorized use of the “American Idol” website creates the false impression that the producer of American Idol supports your activities.
On behalf of American Idol, demand is hereby made that you immediately cease and desist from all unauthorized and unlawful uses of the American Idol intellectual property and that you account to American Idol for any and all profits derived from your use and infringement. I urge you to contact me by telephone at (310) 255-4750 upon receipt of this letter to confirm your understanding or we will proceed accordingly.
Nothing contained in or omitted from this letter waives or relinquishes any of American Idol Productions’ rights, claims, remedies or contentions, whether factual or legal, all of which rights, claims, remedies and contentions are reserved.
